Terms of Service

Effective: October 4, 2026

These Terms of Service ("Terms") are a legal agreement between Keisuke Uemura ("we," "us") and you ("you") governing the iOS/iPadOS application INKPOTTER and the related services we provide, including web viewing (together, the "Service"). By downloading, installing, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country, if higher) to use the Service. By using the Service, you represent that you meet this requirement and that your use complies with laws that apply to you.

2. About the Service

INKPOTTER is an app where posts are made entirely by hand, using a finger or Apple Pencil. Image import, tracing underlays, and AI-generated content are not available. A draft stays on your device only and is never sent to our servers until you explicitly tap "Save to Server." Anything saved to the server is public content, viewable from a web browser by anyone with the share link.

Saving to the server requires signing in with Sign in with Apple. We may add, change, or remove features at any time.

3. Accounts

Sign-in uses Sign in with Apple. You're responsible for everything done through your sign-in. We may suspend or terminate access under Section 10 if we believe these Terms have been violated or your access has been compromised.

4. Your Content and Its Visibility

Hand-drawn posts you create through the Service ("User Content") remain yours. We claim no ownership over User Content.

Saving User Content to the server means publishing it. Anyone with the share link can view saved User Content from a web browser, whether or not they have the app or an account. If you don't want something public, keep it as an on-device draft and don't save it to the server.

To provide the Service, you grant us a limited, non-exclusive, worldwide license to store, transmit, display, back up, and otherwise process your User Content as needed to operate the Service. This license ends when your User Content is removed from our systems, except for copies kept for a reasonable time as part of routine backups or as required by law.

You're solely responsible for your User Content and represent that you have the right to create and publish it through the Service. You agree not to create, store, or publish through the Service any content that (a) infringes a third party's intellectual property, privacy, or other rights, (b) violates laws that apply to you, (c) is intended to seriously harass, discriminate against, or otherwise harm others, or (d) contains malicious code intended to damage the Service or other users.

5. Reporting and Moderation

The web viewer page a share link opens has a "Report this post" link, which anyone can use to report it to us directly — no sign-in required. For anything else, please contact us. We may unpublish or remove User Content we reasonably believe violates these Terms, without prior notice.

6. Backups and Data Loss

We take reasonable measures to protect saved data, but no software or online service can completely prevent data loss from technical failure, service interruption, or other causes. Drafts that haven't been saved to the server exist only on your device, so we're not responsible for their loss due to a lost or damaged device, for example. To the fullest extent permitted by law, we're not liable for loss of User Content, and any such loss is subject to Section 13 (Limitation of Liability).

7. Advertising

The Service is partly supported by a single ad slot on the History screen, served by Google AdMob as non-personalized ads. We don't individually curate ad content — it follows Google's own serving policies. If you have concerns about an ad, please contact us.

8. Prohibited Uses

You agree not to:

9. Intellectual Property

The Service (excluding User Content), including its software, design, and branding, is owned by us or our licensors and protected by copyright, trademark, and other laws. Except for the limited right to use the Service granted by these Terms, no rights in the Service itself are granted to you.

10. Suspension and Termination, Discontinuing the Service

You may stop using the Service at any time. We may suspend or terminate your access to the Service or your account, with notice where reasonably possible, if we believe you have materially violated these Terms, if required by law, or if reasonably necessary to protect the Service or other users. Sections that by their nature should survive termination (including Sections 4, 6, 9, and 10–14) survive.

We may also modify, suspend, or discontinue the Service, in whole or in part, temporarily or permanently, at any time, with reasonable advance notice except where urgent technical or legal reasons make that impracticable. If we discontinue the Service itself, we'll make reasonable efforts to notify you in advance, but we may delete data stored on our servers (including User Content) once the Service has ended. We recommend keeping your own copies of anything important — for example by saving it to your device — while the Service is still available.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, secure, or free of data loss or corruption.

12. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold us harmless from any claim, damage, liability, or expense (including reasonable attorneys' fees) arising from or related to (a) your User Content, (b) your violation of these Terms, or (c) your violation of any law or third-party right.

13. Limitation of Liability

To the fullest extent permitted by law: (A) we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service, even if advised of the possibility of such damages; and (B) our total liability arising from or related to the Service or these Terms will not exceed USD $20.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

14. Dispute Resolution and Governing Law

Let's talk first. Before bringing a claim against us, you agree to contact us at support_inkpotter@monodorg.com, describe the dispute, and attempt to resolve it informally.

These Terms, and any dispute arising from or related to them or the Service, are governed by the laws of Japan, regardless of your country of residence and without regard to conflict-of-law principles. After the informal resolution step above, you and we agree that the Tokyo District Court will have exclusive jurisdiction as the court of first instance over any dispute arising from or related to these Terms or the Service. Where mandatory consumer-protection provisions of your country of residence cannot be waived, this section applies only to the minimum extent necessary to avoid conflicting with them.

15. Changes to These Terms

We may update these Terms from time to time. For material changes, we'll update the effective date above and make reasonable efforts to notify you in the App or by email. Continued use of the Service after a change takes effect means you accept the updated Terms.

16. Apple App Store Terms

If you obtained the App from Apple's App Store, the following additional terms apply, and you and we acknowledge:
